01本規約について
本規約は、mamonis.studio（以下「当方」）が提供する iOS アプリケーション「datum」（以下「本アプリ」）の利用条件を定めるものです。本アプリをダウンロードまたは利用した時点で、本規約に同意したものとみなされます。
本規約は利用者と当方との間の契約であり、Apple Inc.（以下「Apple」）は本規約の当事者ではありません。
02使用許諾
当方は利用者に対し、本規約に従って本アプリを利用者が所有または管理する Apple 製デバイス上で使用する、譲渡不能かつ非独占的な権利を許諾します。利用者は本アプリの複製、改変、逆コンパイル、逆アセンブル、リバースエンジニアリング、再配布を行ってはなりません。
03料金プラン
本アプリは無料で利用できます。無料の状態でも、撮影に関するすべての機能を制限なく使用できます。

有料プランでは、案件を無制限に作成でき、キャプションのアプリ名が除去され、自社ロゴを設定できます。価格は予告なく変更される場合がありますが、既に契約中のサブスクリプションの価格は、利用者の同意なく引き上げられることはありません。
04自動更新サブスクリプション
- お支払いは、購入確定時に利用者の Apple ID アカウントに請求されます
- 現在の期間が終了する24時間以上前に自動更新をオフにしない限り、サブスクリプションは自動的に更新されます
- 更新の料金は、現在の期間が終了する24時間以内に請求されます
- 購入後、App Store のアカウント設定からサブスクリプションの管理および自動更新の解除ができます
- 期間の途中で解約した場合も、残りの期間は有料プランを利用できます。未使用期間の返金は行われません
05買い切りに含まれる範囲
SCOPE OF LIFETIME PURCHASE
含まれるもの
端末内で完結するすべての機能。案件数の制限解除、キャプションのアプリ名の除去、自社ロゴの設定、および今後追加される PDF 報告書出力を含む端末内機能。
含まれないもの
クラウド同期、複数人での共有など、当方に継続的なサーバー費用が発生する機能。これらを将来提供する場合は、別途のオプションとなります。
この範囲は買い切りプランの提供開始時点で定めたものであり、遡って狭められることはありません。
06支払いおよび返金
本アプリの購入手続きおよび決済は、すべて Apple の App Store を通じて行われます。返金の可否および手続きは Apple の定めるポリシーに従うものであり、当方が直接返金を行うことはできません。
07記録の性質について
本アプリが作成する写真および記録は、第三者による証明を伴うものではありません。
本アプリは撮影日時、撮影条件、位置座標などを記録しますが、これらは端末が提供する情報に基づくものであり、当方はその正確性、真正性、非改ざん性を保証しません。本アプリは電子的な時刻認証、公的な記録認証、その他の証明サービスを提供するものではありません。
本アプリで作成した写真および記録を、行政への提出、保険金の請求、訴訟その他の証拠として用いる場合、それが目的に足るかどうかの判断は利用者の責任において行うものとします。当方はその結果について責任を負いません。
また本アプリは、国土交通省が定める工事写真の電子納品基準および電子小黒板の要件に対応するものではありません。
08データの保存とバックアップ
本アプリのデータは利用者の端末内にのみ保存されます。当方はデータの控えを保持していないため、端末の故障、紛失、初期化、アプリの削除等によりデータが失われた場合、当方が復旧することはできません。
利用者は、本アプリの書き出し機能または iOS のバックアップ機能により、必要に応じてデータを保全するものとします。
09禁止事項
- 法令または公序良俗に違反する行為
- 第三者の権利を侵害する態様での本アプリの利用
- 本アプリの複製、改変、リバースエンジニアリング
- 本アプリの機能を有償で再提供する行為
- 当方または第三者の運営を妨害する行為
10免責
本アプリは現状有姿で提供されます。当方は、本アプリが利用者の特定の目的に適合すること、および中断や不具合なく動作することを保証しません。
当方は、本アプリの利用または利用不能により利用者に生じた損害について、当方に故意または重過失がある場合を除き、責任を負いません。当方が責任を負う場合であっても、その範囲は利用者が当該事由の発生前12か月間に本アプリに対して支払った金額を上限とします。
本アプリに関する保証および製品に対する申立てについて、Apple は一切の責任を負いません。
11サービスの変更および終了
当方は、本アプリの内容を変更し、または提供を終了することがあります。提供を終了する場合、可能な限り事前に告知します。提供終了後も、既に端末内に保存されているデータは端末上に残り、書き出し機能により保全できるものとします。
12Apple に関する条項
- 本規約は利用者と当方との間の契約であり、Apple は当事者ではありません
- 本アプリの保守およびサポートは当方が行い、Apple はその義務を負いません
- 本アプリが保証に適合しない場合、利用者は Apple に通知することができ、Apple は購入代金を返金することがあります。それを超えて Apple が責任を負うことはありません
- 製造物責任、法令への適合、消費者保護に関する請求を含む、本アプリに関する第三者からの申立てへの対応は当方が行います
- 第三者が本アプリについて知的財産権の侵害を主張した場合、その対応は当方が行います
- Apple およびその子会社は本規約の第三受益者であり、利用者が本規約に同意した時点で、本規約を利用者に対して執行する権利を有します
13準拠法および管轄
本規約は日本法に準拠します。本アプリに関して当方と利用者との間に紛争が生じた場合、当方の所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。
14本規約の変更
当方は本規約を変更することがあります。変更後の規約は本ページに掲示した時点から効力を生じます。重要な変更を行う場合は、本アプリ内または本ページで告知します。
01About these terms
These terms govern your use of the iOS application datum ("the app"), provided by mamonis.studio ("we"). By downloading or using the app, you agree to these terms.
This agreement is between you and us. Apple Inc. ("Apple") is not a party to it.
02Licence
We grant you a non-transferable, non-exclusive right to use the app on Apple-branded devices that you own or control, in accordance with these terms. You may not copy, modify, decompile, disassemble, reverse engineer or redistribute the app.
03Plans
The app is free to use. Every capture feature is available without restriction in the free tier.

Paid plans remove the site limit, remove the app name from captions, and allow you to set your own logo. Prices may change, but the price of an active subscription will not be increased without your consent.
04Auto-renewing subscriptions
- Payment is charged to your Apple ID account at confirmation of purchase
- Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period
- Your account is charged for renewal within 24 hours prior to the end of the current period
- You can manage subscriptions and turn off auto-renewal in your App Store account settings after purchase
- If you cancel mid-period, access continues until the end of that period. Unused portions are not refunded
05Scope of the lifetime purchase

Included
Every feature that runs entirely on your device: unlimited sites, removal of the app name from captions, your own logo, and future on-device features including the planned PDF report export.
Not included
Features that carry ongoing server costs for us, such as cloud sync and multi-user sharing. Should we offer these in future, they will be sold separately.
This scope was defined when the lifetime plan was first offered and will not be narrowed retroactively.
06Payment and refunds
All purchases are processed through the Apple App Store. Refunds are governed by Apple's policies. We cannot issue refunds directly.
07Nature of the records
Photos and records created by the app are not certified by any third party.
The app records capture times, capture conditions and coordinates, all based on information provided by your device. We do not warrant their accuracy, authenticity or freedom from tampering. The app provides no trusted timestamping, no official record certification and no other form of attestation.
If you use photos or records created with the app for submissions to authorities, insurance claims, litigation or any other evidentiary purpose, it is your responsibility to determine whether they are adequate for that purpose. We accept no liability for the outcome.
The app does not conform to the Japanese Ministry of Land, Infrastructure, Transport and Tourism standards for electronic delivery of construction photographs or electronic site boards.
08Storage and backups
App data is stored only on your device. We hold no copy, so if data is lost through device failure, loss, reset or deletion of the app, we cannot recover it.
You are responsible for safeguarding your data using the app's export function or the backup facilities of iOS.
09Prohibited conduct
- Any use that violates law or public order
- Use of the app in a manner that infringes the rights of others
- Copying, modifying or reverse engineering the app
- Reselling the app's functionality
- Interfering with our operations or those of third parties
10Disclaimer and limitation of liability
The app is provided as is. We do not warrant that it is fit for any particular purpose, nor that it will operate without interruption or defect.
Except in cases of our wilful misconduct or gross negligence, we are not liable for damages arising from use of, or inability to use, the app. Where we are liable, our liability is limited to the amount you paid for the app in the twelve months preceding the event.
Apple has no warranty obligations whatsoever with respect to the app.
11Changes to and discontinuation of the service
We may change the app or discontinue it. Where we discontinue it, we will give notice in advance where possible. Data already stored on your device remains on the device and can be safeguarded using the export function.
12Apple-related provisions
- This agreement is between you and us; Apple is not a party
- We, not Apple, are solely responsible for maintenance and support of the app
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. Apple has no other warranty obligation
- We, not Apple, are responsible for addressing third-party claims relating to the app, including product liability, regulatory compliance and consumer protection claims
- We, not Apple, are responsible for the investigation and defence of any third-party claim that the app infringes intellectual property rights
- Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, will have the right to enforce them against you
13Governing law and jurisdiction
These terms are governed by the laws of Japan. Any dispute shall be submitted to the exclusive jurisdiction of the court having jurisdiction over our place of business as the court of first instance.
14Changes to these terms
We may revise these terms. Revised terms take effect when posted on this page. Material changes will be announced in the app or on this page.
